Understanding Goods and Property Rights
Concept of Goods
- The distinction between "things" and "goods" is introduced, emphasizing that for something to be considered a good, it must not only be useful but also subject to appropriation.
- Common resources such as stars, air, and the high seas cannot be objects of legal relations due to their shared nature.
Types of Rights
- Discussion on real rights (derechos reales), which directly pertain to a thing. Examples include property, inheritance, usufruct, active servitude, rent, and mortgage.
- Real rights can apply to both tangible (material) items like houses or books and intangible (immaterial) items such as copyright.
Classification of Things
- Tangible things are described as corporeal; they have a real existence and can be perceived through the senses.
- Intangible things are referred to as incorporal; they consist of rights or claims rather than physical objects.
