Real, Apparent, Legal, and White-Collar Crime

  • Apparent Criminality: Comprises crimes that come to the attention of authorities (police, mayors, judges) through direct reports or confidential information. It includes all punishable behaviors reported via complaints or other communication methods.
  • Legal Criminality: Involves crimes that have been formally investigated by competent authorities and for which provisional decisions have been made. This includes important but not definitive decisions in the criminal process such as appeals or accusations.
  • White-Collar Crime: Defined as crimes committed by respectable individuals at high social levels while performing their duties. Common examples include influence peddling, fraud, money laundering, bribery, corporate bankruptcy fraud, and organized crime.
