  • This program is a dramatization inspired by real-life events and legal cases, with names changed for privacy protection.

Case Background

Legal Proceedings Initiation

Opening Statements

  • The judge confirms that all legal conditions for initiating an oral trial have been met and opens the hearing formally. The prosecutor presents their opening arguments, emphasizing the state's commitment to justice for victims of crimes committed by public officials.

Allegations Against Officials

  • The prosecution alleges that three public officials tortured Lucero Cueto both physically and psychologically to obtain a false confession, without informing her of her rights during detention. Evidence will be presented to support these claims.

Defense Arguments

Defense's Position

  • The defense argues that the prosecution cannot prove beyond reasonable doubt that their clients participated in any wrongdoing, asserting they acted within legal boundaries during Cueto's arrest on May 28th. They highlight that their clients have no criminal records or prior involvement in similar cases.

Contradictory Claims

  • Both parties present conflicting narratives: while the prosecution claims torture occurred, the defense maintains adherence to legal protocols during Cueto's arrest and processing at the Ministry Publico. A request for evidence presentation follows this exchange.

Testimony from Lucero Cueto

Initial Testimonies and Allegations

  • The witness, Señorita Cueto, was questioned about her statements regarding police misconduct. She confirmed that she did not disclose the alleged actions of the police until later.
  • The prosecutor informed Cueto that she was under investigation for robbery, which is significant to the context of her testimony.

Witness Examination Process

  • The defense completed its cross-examination, and the prosecution continued with presenting evidence through witnesses.
  • A key witness, Alcésar, testified about observing signs of probable torture against Cueto by two police officers and a public prosecutor.

Medical Evaluation Findings

  • Dr. Laura González conducted an evaluation using the Istanbul Protocol to assess Cueto's claims of torture.
  • González concluded that there was physical aggression against Cueto, indicating instances of torture.

Cross-Examination of Medical Expert

  • During cross-examination, it was revealed that no photographic evidence or detailed records were available regarding Cueto's injuries.
  • Dr. González stated that while the medical examination did not validate signs of torture directly, it necessitated further investigation using established protocols.

Psychological Assessment Insights

  • A psychologist emphasized the importance of applying the Istanbul Protocol in cases involving allegations of torture and confirmed its application on Cueto with positive results.
  • The psychologist acknowledged potential for false reporting but asserted trained professionals could identify inconsistencies during assessments.

Defense Statements from Accused Officers

Defense's Counterarguments

  • The defense argues that the prosecution failed to prove guilt beyond reasonable doubt, noting no prior incidents involving the accused officers.
  • They highlight inconsistencies in Ms. Cueto’s testimony regarding her detention duration and lack of physical injuries as reported by medical professionals.

Conclusion on Credibility

Legal Proceedings and the Istanbul Protocol

Defense Arguments and Requests

  • The defense argues for the acquittal of three public officials, asserting that their actions were lawful and did not constitute a violation of rights.
  • A judge is expected to either convict or acquit the accused, with anticipation surrounding the forthcoming verdict.

Judicial Clarifications

  • The speaker expresses skepticism towards the prosecutor's request, emphasizing that a clear explanation is necessary as the ruling will be read later.
  • There is an assertion that it cannot be concluded that the actions of police officers and prosecutors were entirely legal; however, no formal declaration of illegality will be made.

Examination of Evidence

  • The victim's testimony needs corroboration; special attention was given to Dr. Laura González’s statement regarding the application of the Istanbul Protocol.
  • Dr. González claims physical aggression occurred based on her methodology under the protocol but does not address moral aspects which lack tangible evidence.

Psychological Insights

Video description
